Who can apply for this visa?
  • Parents - Parents may apply for family reunion visa to reunite with their child who is an Australian Citizen, Australian Permanent Resident or a child of an eligible New Zealand Citizen. 
  • Children - Dependent children (under the age of 18) who are the parents’ child Australian citizens or permanent residents and who submit either an offshore (Subclass 101) child visa applicant or an onshore child visa application (Subclass 802).
  • Other Relatives - Other relatives with no other close family overseas are eligible to apply for a Remaining Relative Visa (Subclass 115/835).

Visa Subclasses

Child Visa (Subclasses 101/802) and Adoption Visa (Subclass 102)

The Child Visa is for dependent or unfathered children of an Australian citizen or endless occupant. The Subclass 101 visa is for offshore applicants. The Subclass 802 visa is for onshore applicants.

Contributory Parent Visas 143/173 and Parent Visa 103/804

They're issued for the parents of Australian citizens, permanent residents or eligible New Zealand citizens. The Subclass 143 is classified as permanent, while Subclass 173 is a temporary visa that allows one to apply for permanent residence later, and the Subclass 103 has very slow processing times. The Subclass 804 is exclusively available to persons in the country.

Remaining Relative Visa (Subclasses 115/835) & Carer Visa (Subclasses 116/836)

This Remaining Relative Visa allows individuals to be sponsored by people who have no other close family available to them outside of Australia. Carer Visa enables people to come to Australia to take care of a relative with a medical condition.

Pathway to Residency

A number of family visas also offer a permanent residency pathway from temporary residency. An example is the Partner Visa (subclass 820/801).

Compulsory Sponsorship

In most cases, family visas are backed by an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. Health and character requirements must also be met.

Requirements

  • Evidence of Family Relationship - We will need evidence of the relationship; this could be in the form of birth certificates, or adoption documents, or evidence of dependency for family visa subclass.
  • Health Checks for Applicant and Sponsor - If the applicant is required to have health checks this will also apply to the sponsor (if applicable).
  • Character Checks for Applicant and Sponsor - Both parties also need to provide police clearances to achieve character requirements and satisfy the eligibility requirements for visa approval.
  • Demonstration of Financial Support - The Australian sponsor needs to demonstrate ability to support the applicant with evidence of financial ability to support the applicant and meet their living cost in Australia without recourse to government support.
  • Demonstration of Dependency or Care - If applying for a Carer Visa or Child Visa we will need to provide evidence that there is dependency on the applicant or that there is a medical need for care.
  • Aged Parent Visa Specific requirements - If the applicant is over pension age there may be some additional documentation requirements in providing evidence to confirm eligibility for the Aged Parent Visa.

The Family Visa application process consists of a few simple steps that must be completed in the right order to obtain a successful outcome. Here is the general process:

Key Stages:

  • Eligibility & Document Submissions – Firstly, check you are eligible, (eg Child, dependant relative, or carer of an Australian citizen or permanent resident). Then obtain and submit documents such as proof of your relationship, identity documents, and document evidence of your financial support of family members.
  • Verification & Health/Character Checks – Being interviewed or checked on health, police checks, and other document verifications may be required before completing Immigration steps and standards.
  • Final Approval – All this comes to a conclusion in an affirmation that your Family Visa has been approved after review and completed, to allow you to live with your family in Australia.

A Family Visa allows people to meet with their family in Australia. There are many subclasses for parents, children, and other relatives who would like to live in Australia either permanently or temporarily.

Processing times vary based on visa subclass. Processing times range from a few months to years. Variability in the time for your application can include subclass, applicant circumstance and completeness of application.

You need to submit documents which establish your connection to the sponsor by presenting birth or marriage certificates. Also submit identification documents along with financial support evidence and health and character assessments which apply to both you and the sponsor.

When it comes to work rights during the application process, this can be dependent on the visa subclass. Some applicants will receive a Bridging Visa and have the ability to work while they wait for a decision to be made on their Family Visa.
